National Security Examined by Top Legal Experts

SAN DIEGO , Jan. 5 /PRNewswire-USNewswire/ -- Three programs will analyze national security during the Association of American Law Schools (AALS) Annual Meeting ( January 6-10, 2009 ) in San Diego .

National Security Law Advice to the New Administration is a program sponsored by the AALS Section on National Security Law. The panelists for this program will explore a range of issues that President Obama's new administration will face including reforming the U.S. posture in domestic and international national security law, restoring an emphasis on human and societal security and providing a new set of models for detention and adjudication of suspected terrorists.

"The next administration will confront several national security challenges," says William C. Banks , professor of law and director of the Institute for National Security and Counterterrorism at Syracuse University. "We believe this panel will offer insightful and creative ways the new administration could shape its national security policies." This program will occur on Thursday, January 8 , from 8:30 - 10:15 a.m. at the San Diego Marriott and Marina.

The AALS Section on Federal Courts is also sponsoring a program titled Habeas Corpus and the War on Terror. This panel of legal experts will review the issues surrounding federal jurisdiction and the Government's detention and treatment of alleged enemy combatants and other individuals connected with the war on terror. Some of these issues include the availability of judicial review, under the Constitution, in cases of Executive detention; the extent to which any right to habeas corpus based review depends on the citizenship of the detainee; and the extent of Congress's power to limit the federal courts' habeas jurisdiction. The panel will also review developments in the Supreme Court and lower courts relating to habeas corpus and the war on terror. This program will occur on Friday, January 9 , from 3:30 - 5:15 p.m. at the San Diego Marriott and Marina.

Take Arms Against a Sea of Troubles? is a program sponsored by the AALS Section on Admiralty and Maritime Law and co-sponsored by the AALS Sections on International Law and National Security Law. This panel will discuss international, regional, and unilateral measures to enhance maritime security since 2001 (such as the Proliferation Security Initiative, the U.S. Container Security Initiative, Australia's Maritime Identification System, and anti- piracy proposals before the United Nations) and any tension that these may generate with established maritime rules and regimes. This program will occur on Thursday, January 8 , from 10:30 a.m. - 12:15 p.m. at the San Diego Marriott and Marina.
